United Democratic Movement v President of the Republic of South Africa and Others (African Christian Democratic Party and Others Intervening ; Institute for Democracy in South Africa and Another as Amici Curiae) (No 2) (CCT23/02) [2002] ZACC 21

This appeal determined whether legislation on floor crossing that allowed members of the national, provincial and local governments to retain their seats despite defecting from parties whose platform they were elected, was inconsistent with the Constitution.

This case interpreted the right to freedom of association in two contexts. First, with regards to section 32(c) of the Constitution that guarantees the right to establish educational institutions based on common culture, language and religion. Second, whether section 32(c) imposes a positive obligation on the state to establish minority schools.
