The 2nd respondent joined the 8th parliament as an independent candidate. In August 2010, without resigning from his parliamentary seat, he offered himself on the NRM ticket to contest as a member of parliament in the 9th parliament. The petitioner contested the constitutionality of the 2nd respondent’s nomination, hence the petition.
This was a petition to declare the refusal by the 1st respondent’s, the Electoral Commission, refusal to register a political party in the names of “KABAKA YEKKA”, as unconstitutional. The refusal was made on grounds that the name contravened the provisions of sections 5(1) and 16(1) of the Political Parties and Organisations Act 2005 (PPOA)and as it was likely to be confused with the Kingdom of Buganda. The petitioner contended that the refusal contravened their right and freedom of association guaranteed by the Constitution.
