The appellants were elected as Members of Parliament under sponsorship of the United National Independence Party (UNIP), during the one-party regime. The Constitution was thereafter amended and allowed Zambia to be a multi-party state. The appellants resigned from UNIP and joined the Movement for Multi-Party Democracy.
This was an appeal against a refusal by the High Court to grant the appellants leave to apply for judicial review.
The appellants had formed a society called Movement for the Restoration of the Barotseland Agreement (MOREBA). They applied to the Registrar of Societies for registration of MOREBA. The Registrar rejected the application. Their appeal to the Minister of Home Affairs was also rejected and they were ordered to cease operations in the name of MOREBA.
This was an appeal against the decision of the High Court concerning matters arising out of the Open Day activities of the Molepolole College of Education, which took place on 11 September 1993, and matters arising out of Regulation 6 of the College Regulations.
