Formation of civil rights organisation

The petitioner, the Kenya National Parents Association, challenged the decision of the 1st and 2nd respondents, the cabinet secretary and principal secretary Ministry of Education, to carry out elections for parent associations for schools in Kenya. The petitioners argued that their right to freedom of association and right to conduct its affairs without interference were thus infringed.

This was an appeal against the decision of the High Court that held that the refusal of the appellants, the Non-Governmental Organizations Co-Ordination Board, to register the respondent, an organization seeking to protect the LGBTIQ community in Kenya, was in contravention of their right to freedom of association.

This was an appeal against a refusal by the High Court to grant the appellants leave to apply for judicial review.

The appellants had formed a society called Movement for the Restoration of the Barotseland Agreement (MOREBA). They applied to the Registrar of Societies for registration of MOREBA. The Registrar rejected the application. Their appeal to the Minister of Home Affairs was also rejected and they were ordered to cease operations in the name of MOREBA.
