Paul Kafeero and Anor v Electrol Commision and Attorney General (Constitutional Petition 22 of 2006) [2008] UGCC 53 (30 April 2008);
This was a petition to declare the refusal by the 1st respondent’s, the Electoral Commission, refusal to register a political party in the names of “KABAKA YEKKA”, as unconstitutional. The refusal was made on grounds that the name contravened the provisions of sections 5(1) and 16(1) of the Political Parties and Organisations Act 2005 (PPOA)and as it was likely to be confused with the Kingdom of Buganda. The petitioner contended that the refusal contravened their right and freedom of association guaranteed by the Constitution.
