Limitation of right of free association

This was an application for leave for judicial review and an order of interlocutory injunction restraining the respondents, the IG of Police and the Commissioner of Police (central), their agents from enforcing the disapproval of holding whistle stop tours in Lilongwe and Salima. Leave for judicial review was granted on 26 August 2008.

 

This was a referral by the Attorney General for the interpretation of section 65 of the Constitution and of crossing the floor by members of parliament. 

 

This was an application to nullify presidential directives given at a political rally. The directive banned and criminalised public processions or mass rallies against a constitutional amendment that sought to allow the president to serve an unlimited office term. The applicants argued that the ban violated their rights to freedom of association, assembly and demonstration, expression, conscience, opinion, and political rights, as guaranteed in sections in sections 32, 33, 34, 35, 38 and 40 of the Constitution.
